8returns AI Terms

8returns GmbH, Pappelallee 78/79, 10437 Berlin, Germany (“8returns”, “we”, “us” or “our”) provides a cloud-based returns management platform and related services (the “Software”) to you (“Customer”, “you” or “your”) on the basis of the 8returns General Terms and Conditions, Master Services Agreement, or other applicable agreement between you and 8returns (the “Agreement”).

8returns may offer artificial intelligence-enabled features and functionality within the Software, including within the Returns Portal, analytics dashboard, merchant administration interface, reporting tools, workflow automation, support tools, and other product areas. Such features may be powered by third-party artificial intelligence models, machine learning models, large language models, image analysis models, or related AI infrastructure providers (“8returns AI”).

These AI Terms (“AI Terms”) supplement and form part of the Agreement and apply to your access to and use of 8returns AI across the Software. In the event of a conflict between these AI Terms and the Agreement, these AI Terms shall apply solely with respect to 8returns AI. Unless otherwise defined in these AI Terms, capitalized terms have the meaning given to them in the Agreement.

1. AI Content

1.1 Input and Output

You, your Authorized Users, or end users may provide or make available information, content, images, return-related information, merchant configuration data, product information, product variant data, analytics data, reporting data, return reasons, free-text comments, troubleshooting guidance, workflow instructions, prompts, queries, or other data to be processed by 8returns AI (“Input”).

8returns AI may generate, return, display, or suggest classifications, recommendations, sufficiency assessments, troubleshooting matches, analytics insights, reports, summaries, explanations, workflow suggestions, exchange or replacement suggestions, short suggested text, or other AI-generated responses based on the Input (“Output”).

Input and Output are together referred to as “AI Content”.

1.2 Customer Data

AI Content is Customer Data within the meaning of the Agreement, to the extent it is submitted to, generated through, or processed by 8returns AI on your behalf.

You acknowledge that Output may not be unique. Other customers, merchants, users, or end users providing similar Input may receive the same or similar Output. Such similar or identical Output generated for others is not your Customer Data.

1.3 Right to Use AI Content

You grant 8returns the right to process AI Content and other Customer Data submitted to or generated through 8returns AI to provide, maintain, secure, monitor, and improve the functionality, performance, and reliability of 8returns AI and the Software, in each case in accordance with the Agreement, these AI Terms, and the applicable Data Processing Agreement.

This includes the use of third-party providers and subprocessors where required to provide 8returns AI.

1.4 Ownership of 8returns AI

As between you and 8returns, 8returns owns all rights, title, and interest in and to 8returns AI, the Software, and all related technology, models, workflows, configurations, prompts, logic, algorithms, know-how, and intellectual property rights.

Except for the rights expressly granted under the Agreement and these AI Terms, no rights or licenses in or to 8returns AI are granted to you.

2. Our Commitments

2.1 No Training of General-Purpose AI Models

8returns does not use, and does not permit its third-party AI providers to use, your AI Content or Customer Data to train general-purpose third-party AI models, unless you have expressly agreed otherwise.

8returns may process AI Content and related usage data as necessary to provide, maintain, secure, monitor, debug, and improve 8returns AI and the Software, subject to the Agreement, the applicable Data Processing Agreement, and applicable law.

2.2 AI-Assisted Functionality

8returns AI is designed to assist with return-related, analytics, reporting, workflow, and operational use cases across the Software. Depending on the enabled functionality, 8returns AI may support use cases such as:

  • matching free-text return comments to merchant-configured return reasons;
  • assessing whether a return comment appears sufficient;
  • assessing whether an uploaded image appears sufficient for the return flow;
  • matching troubleshooting guidance to the return context;
  • suggesting exchange options, in-stock variants, or same-item replacements;
  • generating short suggested return-reason text options;
  • supporting analytics, reporting, and dashboard insights;
  • identifying trends, patterns, or anomalies in return-related data;
  • summarizing or explaining operational information shown in the Software;
  • assisting with workflow configuration, automation, or decision support; and
  • supporting other AI-enabled product functionality made available by 8returns from time to time.

8returns AI is assistive and advisory in nature. It does not make final return, business, legal, or operational decisions on behalf of the Customer, merchant, Authorized User, or end user. Users may, where supported by the product flow, review, ignore, reject, or override AI-generated suggestions, warnings, recommendations, insights, or other Output.

2.3 Changes to Models and Providers

8returns AI may rely on third-party AI models, AI infrastructure providers, routing providers, logging or observability tools, and related service providers.

The specific AI models, model versions, providers, technical configurations, and AI-enabled features used to provide 8returns AI may change from time to time. 8returns may update, replace, or modify the AI models, providers, configurations, or AI-enabled functionality used to deliver 8returns AI, provided that such changes are handled in accordance with the Agreement, the applicable Data Processing Agreement, and any applicable subprocessor notification requirements.

2.4 Availability

8returns will make 8returns AI available in accordance with the Agreement and any applicable service level commitments.

However, unavailability, downtime, delay, or degradation of 8returns AI resulting from third-party AI providers, model providers, infrastructure providers, routing providers, or other third-party services may be excluded from availability or downtime calculations to the extent permitted under the Agreement.

3. Customer Responsibilities and Restrictions

3.1 Use of 8returns AI

You are responsible for your and your Authorized Users’ use of 8returns AI, including the configuration of return flows, return reasons, troubleshooting guidance, analytics dashboards, reports, workflows, product data, product variants, merchant-provided content, and other data or settings used by 8returns AI.

You will ensure that AI Content and your use of 8returns AI do not:

  1. violate applicable law;
  2. violate the Agreement or these AI Terms;
  3. infringe, violate, or misappropriate any rights of 8returns or any third party;
  4. include unlawful, harmful, deceptive, discriminatory, defamatory, or rights-infringing content; or
  5. include personal data, sensitive data, or confidential information that is not necessary for the relevant use of the Software or that you are not permitted to provide.

You are responsible for informing your Authorized Users and end users, where required, about the use of AI-assisted functionality within the Software.

3.2 End User Inputs

8returns AI is not intended to receive direct customer identifiers such as customer names, email addresses, shipping addresses, order numbers, payment details, or support tickets as part of prompts sent to AI model providers, unless otherwise expressly agreed.

However, you acknowledge that free-text fields, prompts, queries, uploaded images, support inputs, analytics data, or other user-provided content may contain personal data if such information is provided by an Authorized User or end user. You are responsible for ensuring that your use of 8returns AI and your configuration of the Software are appropriate for your business processes and legal obligations.

3.3 Verification of Output

Due to the nature of artificial intelligence, Output may be inaccurate, incomplete, outdated, biased, misleading, unsuitable, or not appropriate for a specific case.

You, your Authorized Users, and end users should not rely on Output without independently evaluating its accuracy, appropriateness, and suitability for the intended use. You remain responsible for decisions, actions, communications, configurations, business processes, and outcomes made or taken in connection with your use of 8returns AI.

3.4 Fair Use

To ensure fair and reliable use of 8returns AI, you may only use 8returns AI to an appropriate and reasonable extent.

Excessive, abusive, automated, or unreasonable use that negatively impacts the performance, security, cost, or availability of 8returns AI or the Software is prohibited. 8returns reserves the right to monitor usage and impose reasonable limits, restrictions, throttling, or suspension where necessary to maintain service quality, security, and availability.

3.5 Use Restrictions

You may not use 8returns AI:

  1. to develop, train, or improve foundation models, large language models, image analysis models, or other AI models that compete with 8returns AI or the Software;
  2. to mislead any person into believing that Output was solely human-generated where disclosure is required;
  3. to make decisions that produce legal or similarly significant effects concerning individuals without appropriate human involvement, where such involvement is required by applicable law;
  4. to engage in unlawful, discriminatory, deceptive, harmful, or abusive practices;
  5. to process sensitive personal data unless expressly supported by the Software and permitted under the Agreement;
  6. to reverse engineer, extract, copy, or infer underlying models, prompts, systems, algorithms, or source code;
  7. to circumvent safety, security, usage, or access restrictions; or
  8. in a manner that violates applicable third-party provider policies.

3.6 Third-Party Provider Policies

8returns AI may use technology provided by third-party AI providers and related infrastructure providers, including providers used for AI models, image analysis, routing, logging, observability, hosting, or other technical services.

You may not use 8returns AI in a manner that violates applicable third-party provider policies, acceptable use policies, safety policies, or usage restrictions.

3.7 Suspension and Modification

8returns may modify, limit, suspend, or discontinue 8returns AI or your access to 8returns AI where reasonably necessary to:

  1. comply with applicable law;
  2. comply with third-party provider requirements;
  3. protect the security, integrity, or availability of 8returns AI or the Software;
  4. prevent misuse or excessive use;
  5. address legal, regulatory, security, or operational risks; or
  6. make product, provider, model, or infrastructure changes.

Where reasonably practicable, 8returns will provide notice in accordance with the Agreement.

4. Warranty Disclaimer

YOU ACKNOWLEDGE THAT 8RETURNS AI IS POWERED BY ARTIFICIAL INTELLIGENCE TECHNOLOGY, WHICH MAY PRODUCE OUTPUT THAT IS INACCURATE, INCOMPLETE, OUTDATED, MISLEADING, BIASED, UNSUITABLE, OR OTHERWISE INCORRECT.

8RETURNS DOES NOT WARRANT THAT AI CONTENT OR OUTPUT WILL BE ACCURATE, COMPLETE, RELIABLE, ERROR-FREE, SUITABLE FOR YOUR SPECIFIC PURPOSES, OR COMPLIANT WITH YOUR LEGAL, BUSINESS, OR OPERATIONAL REQUIREMENTS.

YOU UNDERSTAND AND AGREE THAT YOUR USE OF 8RETURNS AI AND ANY AI CONTENT IS AT YOUR OWN RISK. YOU SHOULD NOT RELY ON FACTUAL ASSERTIONS, CLASSIFICATIONS, RECOMMENDATIONS, IMAGE ASSESSMENTS, SUFFICIENCY VERDICTS, TROUBLESHOOTING MATCHES, EXCHANGE SUGGESTIONS, ANALYTICS INSIGHTS, REPORTS, SUMMARIES, WORKFLOW SUGGESTIONS, OR OTHER OUTPUT WITHOUT INDEPENDENTLY EVALUATING THEIR ACCURACY AND APPROPRIATENESS.

NO INFORMATION OR ADVICE, WHETHER ORAL OR WRITTEN, OBTAINED FROM 8RETURNS, THE SOFTWARE, OR 8RETURNS AI SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THE AGREEMENT.

Nothing in these AI Terms limits or excludes liability that cannot be limited or excluded under applicable law.

5. Data Privacy

To the extent AI Content contains personal data, you instruct 8returns and its subprocessors to process such personal data for the purpose of providing, maintaining, securing, monitoring, and supporting 8returns AI and the Software, as further described in the applicable Data Processing Agreement.

The Data Processing Agreement governs the processing of personal data in connection with 8returns AI.

Depending on the enabled functionality, 8returns AI may process merchant configuration data, product information, product variant data, return reasons, free-text return comments, uploaded item images, analytics data, reporting data, dashboard queries, workflow configuration data, troubleshooting guidance, AI inputs and outputs, and related technical or usage metadata.

8returns does not intentionally send direct customer identifiers such as customer names, email addresses, shipping addresses, order numbers, payment details, or support tickets to third-party AI model providers as part of AI prompts, unless otherwise expressly agreed. However, free-text fields, prompts, queries, uploaded images, analytics data, or other user-provided content may contain personal data if provided by Authorized Users or end users.

8returns AI may rely on third-party providers and subprocessors, including AI model providers, routing providers, infrastructure providers, and logging or observability providers. Such providers will be listed or notified in accordance with the Agreement, the applicable Data Processing Agreement, and 8returns’ subprocessor documentation.

6. Miscellaneous

6.1 Modifications

8returns may introduce new AI features and functionality or modify existing 8returns AI features from time to time.

When doing so, 8returns may update these AI Terms to reflect such changes. To the extent required by applicable law or the Agreement, 8returns will provide at least thirty (30) days’ notice before updated AI Terms take effect.

6.2 Agreement Remains in Effect

All other terms and conditions of the Agreement remain in full force and effect. These AI Terms supplement the Agreement only with respect to 8returns AI.

6.3 Order of Precedence

In the event of a conflict between these AI Terms and the Agreement, these AI Terms shall control solely with respect to 8returns AI, unless the Agreement expressly states otherwise. In the event of a conflict between these AI Terms and the Data Processing Agreement regarding the processing of personal data, the Data Processing Agreement shall control.
